The article discusses the methodological problems of a "historical legal history." After a critical analysis of different approaches, two cases - the evolution of commercial justice in modem Germany and France - illustrate an analytical approach to the legal structure of economic and social systems for which the author advocates. In analysing the slow process of differentiation of the complex-functions which were significant for the commercial courts in the two countries, it tries to combine the theory of legal temporalities with a historical critique of judicial topics in the construction of a method that would be appropriate to give an account of the mechanisms of adaptation which characterise the historical efficiency of legal practice.

The affirmation of the traditional structures qf the two disciplines in the 20th century as a response to the errors of the Nazi era, explains the form taken by the debates on cross-analysis in space and time in Germany in the 1960s and 1990s.

Zusammenfassung Der Artikel erörtert die methodischen Probleme einer „historischen Rechtsgeschichte“. Nach einer kritischen Analyse verschiedener Ansätze veranschaulichen zwei Fälle – die Entwicklung der Handelsgerichtsbarkeit im modernen Deutschland und Frankreich – den analytischen Ansatz zur Freilegung der rechtlichen Struktur von Wirtschafts- und Sozialsystemen, für den der Autor plädiert. Durch die Analyse des langsamen Prozesses der Ausdifferenzierung der komplexen Funktionen, die in den Handelsgerichten beider Länder von Bedeutung waren, versucht er, die Theorie der juristischen Zeitlichkeiten mit einer historischen Kritik der juristischen Topik bei der Konstruktion einer Methode zu verbinden. Dies dient der Konstruktion einer Methode, die geeignet wäre, die Mechanismen der Anpassung zu berücksichtigen, die die historische Effizienz der juristischen Praxis kennzeichnen.

Histoire, loi et justice sont trois concepts centraux des travaux historiques et théoriques de Reinhart Koselleck. L'article s'interroge sur leur rôle dans les controverses de l'immédiat après-guerre et dans les premiers travaux de Koselleck sur l'histoire européenne et allemande, mais également à travers leur formulation théorique ultérieure. Nous nous interrogerons particulièrement sur l'articulation entre l'histoire des mouvements sociaux, l'histoire du droit et la réforme politique et sociale, ainsi qu'à leur signification pour la théorie des temps historiques de Koselleck. La tension entre une expérience primaire incommunicable et ses conditions générales telles qu'elles se laissent reconstruire est dans cette perspective une des conditions essentielles d'une auto-affirmation sous la forme d'une historiographie critique incluant la question de savoir ce qui est juste et conforme au droit.
