This article aims to analyze the living conditions that preceded the incarceration in Socio-Educational Units (USEs) of adolescents and young people who were child laborers. A qualitative study was carried out with 30 socio-educational students serving a restriction or deprivation of liberty measure in three northeastern states. Questionnaires were used to investigate: biosociodemographic characteristics, objective living conditions, the presence/ absence of child labor, the trajectory of child labor and involvement in acts typified as infractions that resulted in the socio-educational measure. The data was analyzed using descriptive statistics and the Statistical Package for the Social Sciences (SPSS) software. The results show that the objective living conditions of the participants are marked by the failure of the state to offer effective public policies that guarantee their fundamental rights. The state is only present in the lives of these adolescents and young people to apply punitive measures such as incarceration in USEs.
