ANALYSIS OF THE NORMATIVITY OF SOUTH AMERICAN COUNTRIES RELATED WITH INTELLECTUAL PROPERTY RIGHTS APPLICABLE TO MEDICINES

This paper presents a review that identifies various commercial and legal mechanisms currently used to maintain favorable conditions for certain pharmaceutical products market. Through a consultation of information to various national authorities of the South American countries and published information, the normative status is set in fields related to the market exclusivity granted to the medicines through patents and other mechanisms; the analysis of this description is done under the perspective of public health guidelines formulated and implemented in several countries of the region.
