“Estado de sítio”: o caso do Morro do Alemão através do pensamento de Giorgio Agamben / “State of siege”: the Alemão Complex case through Giorgio Agamben’s thought

O presente estudo tem como finalidade discutir o Estado de Excecao contextualizando-o no cenario nacional pelo Estado de Sitio no âmbito juridico constitucional do Brasil. Para tanto, tomamos por base duas frentes deste contexto politico-juridico-social: a posicao do filosofo italiano Giorgio Agamben e a posicao juridica tradicional. Objetivando compreender um caso concreto como o “Estado de Sitio”, usamos como exemplo o Complexo do Morro do Alemao no Rio de Janeiro, ocupado em 2010 por forcas militares. Embora existam elementos normativos previstos nos institutos juridicos constitucionais do pais, durante a ocupacao da comunidade, nao foi decretado nenhuma das previsoes legais compreendidas no sistema constitucional de crises, o que pode indicar uma dupla excepcionalidade juridica. AbstractThe present study has the purpose of discussing the of Exception contextualizing it in the national scenario by the of Siege in the juridical constitutional scope of Brazil. For this purpose, we are based on two fronts of this political-legal-social context: the position of the Italian philosopher Giorgio Agamben and the traditional legal position. The study of these theoretical-methodological positions allowed the analysis of a concrete case of State of Siege, the case of the Complexo do Morro do Alemao in Rio de Janeiro, occupied in 2010 by military forces. Although there are normative elements foreseen in the constitutional legal institutes of the country, during the occupation of the community, was not decreed none of the legal forecasts understood in the constitutional system of crisis, which may indicate a double juridical exception.
