人工智能是新一轮技术革命的重要驱动力.近年来我国人工智能(AI)产业发展迅速,部分人工智能产品已经可以独立学习、从事创作活动.AI创作物的独特价值,使得AI创作物的著作权保护出现了诸多疑难.为探究人工智能创作物著作权保护的最优解,推动人工智能产业持续健康发展,笔者依托于2019年的AIPPI决议以及国内司法实践对人工智能创作物著作权归属问题开展研究,认为现阶段应由人工智能创作环节的特定人对人工智能创作物享有著作权.
