Many workers today depend on their 401(k) plan to provide them with an adequate income during retirement. For these workers to achieve retirement income security, their 401(k) plan investments must perform well over their working lifetime. Employers’ selection of investment options for the 401(k) plan, a fiduciary duty under the Employee Retirement Income Security Act of 1974 (ERISA), plays a critical role in determining investment performance. In this Article, Professor Medill uses a series of hypothetical litigation scenarios to illustrate how interpretation of the employer’s duty of prudence and duty of loyalty under ERISA present different policy choices for the federal courts. Professor Medill examines various hypothetical situations involving mutual fund fees and company stock where ERISA’s duty of loyalty will require the federal courts to determine if an employer has received permissible incidental benefits or engaged in prohibited self-interested conduct when selecting 401(k) plan investment options.Because employers today rely upon the Department of Labor’s 404(c) Regulations to allow participants to select among plan investment options without incurring potential fiduciary liability, Professor Medill examines various policy issues likely to arise as federal courts interpret the details of the 404(c) Regulations. The Article cautions against judicial interpretations of the 404(c) Regulations that will have a potential chilling effect on voluntary plan sponsorship by employers. The Article also addresses an important exception to the 404(c) Regulations, the automatic enrollment plan. Professor Medill argues for a judicial interpretation of ERISA that encourages employers to select a default investment option for automatically enrolled participants that is broadly diversified in the equity markets, rather than a low-earning money market fund.The Article concludes by examining the potential remedies available under ERISA for 401(k) plan participants injured by their employer’s breach of fiduciary duty. Professor Medill concludes that, consistent with existing caselaw precedent, federal courts can and should afford injured 401(k) plan participants a remedy under ERISA.
This study explores the critical role of teacher engagement in enhancing teaching performance and student academic achievement in secondary schools in Kathmandu, Nepal. Recognizing that engaged teachers are motivated and dedicated, this research examines the moderating effect of teamwork on teachers’ engagement following professional training. Data were collected from a sample of 320 teachers from both public and private schools and analyzed using descriptive statistics in SPSS and Structural Equation Modeling (SEM) in AMOS. Findings reveal a significant positive relationship between teacher training and professional development, confirming that training directly influences teacher engagement. However, teamwork as a moderating factor did not show a significant catalytic effect on enhancing engagement post-training. This study contributes to the literature by identifying potential gaps in the translation of training into engagement through teamwork, offering new insights into the challenges of fostering collaborative practices that support teacher development in the Nepalese educational context.
Background:Pregnancy disorders or complications must be detected earlier to prevent more dangerous risks for pregnant women and their fetuses. Mother's knowledge about pregnancy danger signs needs to be improved so that early detection of complications can be carried out earlier and treatment of complications is not too late. Promoting knowledge of pregnant women can be carried out through health education activities using a booklet. Objective: To analyze the effectiveness of booklet for promoting knowledge level of pregnant women about pregnancy danger signs. Methods:This research was Quasi Experiment with one group pre and post test design. The Population was all pregnant women that checked her pregnancy in 2022 and the sample collection technique using Purposive Sampling with 50 respondents and divided into 2 groups, intervention group and control group. This study was held in Maternity Clinic of Husniyati, Palembang, Indonesia. Results: there were differences in values before and after intervention using the Wilcoxon Test. P value: 0.008 (<0.05),statistically it means that health education using booklet media has effectively proven on promoting the knowledge level of pregnant women about the pregnancy danger signs. The paper calls for international collaboration, with organizations like WHO and UNAIDS playing pivotal roles in supporting global testing and prevention efforts. Impulsive, non-Gaussian interference in urban 5G/6G wireless scenarios invalidates Gaussian-noise-based assumptions of conventional detectors. This work proposes the use of the Machine Learning-Enhanced Bayesian Detector for DS-CDMA systems over α-stable noise channels. The framework merges probabilistic Bayesian inference with a recurrent neural-network estimator that continuously learns α-stable parameters α, β, γ, and δ from the received data. Closed-form derivations of the detection and false alarm probabilities are obtained using characteristic-function-based likelihood ratios, whereas the proposed approach is corroborated via MATLAB simulations. The results demonstrate that ML-BD provides a 3-dB SINR gain, ≈ 45% BER reduction, and ≈ 15% increase in the detection probability compared to classical Bayesian and energy detectors. This work demonstrates that the marriage of adaptive learning with Bayesian reasoning results in a robust, interpretable, and computationally efficient detector for interference-limited 5G/6G metropolitan networks.
