
El presente trabajo abordó el daño a la autonomía decisoria de las y los pacientes provocado por el incumplimiento del deber de informar del médico en la relación clínica, planteando la hipótesis de que esta categoría tiene un carácter extrapatrimonial y es independiente de los daños corporales que se produzcan en el paciente. En el presente trabajo se ha utilizado el método dogmático y analítico. Reconocer este daño permite distanciarse de la opinión generalizada de la doctrina en Chile que identifica el daño por incumplimiento de deber de informar del médico, exclusivamente, con la pérdida de la oportunidad. Con el fin de corroborar la hipótesis descrita se plantean como objetivos, en primer lugar, indagar sobre los argumentos que han colocado a la pérdida de la oportunidad como daño indemnizable frente al incumplimiento de deber de información de médico; en segundo lugar, analizar el contenido y naturaleza de daño a la autonomía decisoria de las y los pacientes y su aplicabilidad al caso de incumplimiento de deber de informar del médico.
The right to health in Brazil, defined in the 1988 Constitution, is guaranteed and strengthened through a broad structure of participation and social oversight. Transformative structural changes, such as the digital transformation of many aspects of the Brazilian National Public Health System, can be powerful tools for expanding access and equity in services. At the same time, however, they can create new forms of exclusion due to geographical, technological and digital literacy barriers. This research sought to explore, through interviews, the perspectives of representatives of social oversight within the Brazilian National Public Health System regarding the process of digital transformation of health. The results show that the SUS Digital Program has been positively transforming access to services. However, social participation has not yet been fully incorporated, and digital transformation is perceived as a management process lacking social oversight.
Public consultations are a mechanism of social participation in the regulatory process characterized by the discourse of ensuring the effectiveness of the results to promote the democratization of the process and to serve capitalist interests. The Brazilian Health Regulatory Agency is responsible for regulating the health risks related to products and services, constituting both a health action and an instrumentofeconomicorganization within society amid competing interests. This article is a documentary analysis aimed at investigating the attributes and development processes of the Brazilian Health Regulatory Agency's public consultations from January 1999 to April 2023. The documents were categorized into four groups: specific legislation, reports and publications of the Agency, reports and publications of the federal government, and scientific evidence. A total of 654 documents were collected; 350 were selected for full-text review; data were extracted from 50 sources. The institutionalization of procedures to improve regulatory quality in internal norms, driven or not by force of law and decrees, was fundamental to establish standards for publicity, transparency, deadlines, and forms of contribution to public consultations, corroborating evidence of normative advances and institutional performance to promote social participation in technical decision-making spaces. It was also observed that a favorable context in the federal government resulted from the publication of standards related to good regulatory practices in the Brazilian Health Regulatory Agency in 2008, 2018 and 2021, institutionally consolidating public consultations as a practice of social participation in health standardization. However, social participation in public consultations is unequal and the diversity of mechanisms for engagement in regulation may favor better-organized groups. We conclude that investments in education initiatives are necessary, as education is a mediator of qualified participation, a driver of citizen political awareness, and a powerful tool to democratize the regulation of health risk.
Significant scientific progress has been made in understanding the judicialization of health, particularly its normative and institutional causes. However, there are still gaps in describing the profile of litigants in such cases and in understanding how different types of profiles influence the claims made and judicial decision-making. Few studies adjust their findings for socio-economic, age, or gender differences, and even fewer provide information about the race of plaintiffs, with such information remaining largely incomplete. This study contributes to the literature on the subject by examining health judicialization initiated by a specific group-patients under 18. By controlling for age, inequalities by gender and race become more evident. All cases regarding health litigation decided by the Sao Paulo State Court of Justice between 2011 and July 2022, with children or adolescents aged zero to 18 as plaintiffs, were analyzed. The data show a predominance of cases filed on behalf of younger, white children, especially male boys, involving claims related to Autism Spectrum Disorder or Attention Deficit Hyperactivity Disorder. This trend is even stronger within the private health sector. The study suggests that inequalities in access to healthcare services are reflected in different profiles of healthcare litigation
This paper examines the harm to the patient's decision-making autonomy caused by the physician's breach of his duty to inform, proposing the hypothesis that such harm is non-pecuniary in nature and is different from any bodily harm caused to the patient. The study adopts a dogmatic and analytical method. Recognizing this form of damage offers an alternative to the prevailing doctrinal opinion in Chile, which equates the harm resulting from the breach of the physician's duty to inform, exclusively with loss of opportunity. To substantiate the described hypothesis, the objectives are, first, to investigate the arguments that have recognized loss of opportunity as a compensable form of damage in the case under study; and second, to analyze the nature and scope of damage to the patients' decision-making autonomy and its applicability to cases involving breach of the physician's duty to inform.
The political crisis and institutional instability that Peru is experiencing, which has intensified in the current administration (2021-2026), may affect the exercise of regulatory power and, consequently, the implementation of public policies. This may also have an impact on the Ministry of Health's regulatory leadership. In the past, the Office of the Ombudsman and the Congress of the Republic have warned on several occasions that certain health laws have not been regulated. The objective of this article was to analyze the compliance and oversight of health-related laws, legislative decrees, and emergency regulations in Peru, during the current period of government. To this end, a documentary review was conducted of legal norms and official documents relating to the regulatory process in health, issued by the Executive Branch, the Congress of the Republic and the Ombudsman's Office, between 28 July2021 and 31 December 2023. We found that, of the 21 health laws and legislative decrees enacted in that period, only 14.3% (3) were regulated, all of which after the legal deadline. In addition, eight previously enacted health laws and legislative decrees were regulated, with an average time of 701.5 days, all after the deadline. We found no evidence of the application of stricter or more specific institutional controls for the enforcement of such regulations. In conclusion, there remains a high level of non-compliance and prolonged delay in the regulation of health laws and decrees, directly affecting individuals and their right to health. To address this issue, an appropriate legal framework on the regulatory process is required, including political oversight and accountability, the implementation of more specific and rigorous institutionalized controls, and the strengthening of organized civil society.
This article aimed to examine the characteristics of the judgments and judicial interpretations of the Federal Regional Court of the 4th Region concerning the right to health in the area of neoplasms in 2022, especially regarding the evidence of the facts stated in the proceeding and the corresponding decision. Asearch was carried out in the court's jurisprudence, between March and April 2023, identifying 403 judgments issued from January to December 2022. Of the 403 judgments, 361 lawsuits concerned the provision of antineoplastic drugs (89.58%). With regard to elements of evidence, the 361 judgments referring to requests for antineoplastic drugs were specifically analyzed. As for prior expertise, 194 (53.74%) of the 361 antineoplastic drug cases reflected the understanding that this requirement could be waived when the patient was undergoing treatment at High Complexity Oncology Units/ High Complexity Oncology Centers. In such situations, it could be replaced either by technical advice from the Nucleus of Technical Support of the Judiciary or by a favorable decision of incorporation of the medication by the National Commission for Incorporation of Technologies in the Unified Health System. Of these 194 cases, 185 (95.36%) included a request for injunctive relief. It can be concluded that the judicialization of health will remain on the agenda of the Judiciary, whether due to judicial enforceability or the need to understand the role of the State in the implementation of public policies. Thus, it is necessary to strengthen the construction of joint and permanent agendas between the branches of government and Civil Society, aimed at addressing and understanding this phenomenon.
The purpose ofthis article was to analyze, through a literature review, how the extrajudicial action of the Public Prosecutor's Office contributes to the provision of comprehensive health care, within a reasonable timeframe, to patients who are on waiting lists for elective treatments. Using the deductive method, the work focused on the doctrinal and normative analysis of Health Law and differentiated the levels of complexity of treatments adopted in the Brazilian Public Health System, as well as the criteria for classifying urgent, emergency and elective cases. Based on this distinction, the study pointed out that elective patients are deprioritized compared to urgent and emergency cases, as they are sent to a single waiting list, where they await the scheduling of specialized consultations, surgeries and laboratory tests, without an expected service date. Due to the time lapse, patients' health deteriorates, which can have irreversible consequences for their lives, contradicting the state's duty to guarantee fundamental rights. Thus, users of the system look to the Public Prosecutor's Office, an entity authorized to act in court (litigation approach) or outside of it (resolution approach), to restrain the public authorities from executing health services. It was possible to conclude that there is a preference for the use of resolutive acts, such as civil inquiries, public hearings, conduct adjustment agreements and health guidance, to mediate conflicts involving the demands presented. Furthermore, through extrajudicial means, the Public Prosecutor's Office can act as a mediator and assist in the creation of strategies for the implementation of the right to health, in time for the recovery of patients.
The ethical, bioethical, and legal training of medical professionals is of great importance so that they can prevent possible ethical, criminal, civil, consumer, and administrative conflicts. According to the Code of Medical Ethics, such conflicts can lead to the termination of professional practice and may result in punishments in criminal, civil, and administrative areas. In the world of facts, however, there has been an increase in the number of lawsuits against these health professionals, which reveals the occurrence of a phenomenon known as the judicialization of medicine. Given this context and based on the reality of the medical courses located in Fortaleza/CE, we propose to tackle the following question: analyze the possibility of dialogue with the law in the undergraduate medical curriculum, contributing to education aimed at preventing conflicts and the judicialization of medicine in Ceara's capital. This is a bibliographic and documentary study, with a qualitative approach, conducted using the inductive method. The results show that the curriculum of the Universidade de Fortaleza, which stands out in the evaluation of the Brazilian Ministry of Education and Culture, opts for the use of project-based learning. This approach includes the law-medicine relationship in different disciplines, in a transversal way, enabling the construction of the professional identity of its students through experiences that promote a critical and reflective spirit, with the ultimate goal of forming "protagonists of the exercise of caring and healing".
A produção científica acerca da judicialização da saúde avançou bastante sobre suas causas normativas e institucionais. Ainda existem lacunas, no entanto, na descrição do perfil dos litigantes dessas demandas, como os diferentes tipos de perfil impactam o que é demandado e como juízes decidem. Poucos trabalhos controlam seus achados por diferenças socioeconômicas, etárias ou de gênero e, menos ainda, apresentam informações sobre a raça de demandantes, que são ainda bastante incompletas. Este estudo contribui com essa frente da literatura sobre o tema, estudando a judicialização da saúde promovida por um grupo específico – o de pacientes menores de 18 anos. Congelando a variável etária, os dados sobre desigualdade de gênero e raça tornam-se mais evidentes. Foram analisados todos os casos de judicialização da saúde decididos pelo Tribunal de Justiça do Estado de São Paulo, entre 2011 e julho de 2022, que tivessem como demandantes crianças ou adolescentes de zero a 18 anos. Os dados demonstram um predomínio de casos ajuizados em favor de crianças mais jovens, brancas, especialmente do gênero masculino e com demandas relacionadas ao transtorno de espectro autista ou ao transtorno de déficit de atenção e hiperatividade, tendência ainda mais forte junto à saúde suplementar. O estudo indica que desigualdades de acesso a serviços de saúde refletem-se em perfis diferentes de judicialização.
Este artigo teve como objetivo conhecer as características dos julgados e entendimentos jurisdicionais do Tribunal Regional Federal da 4ª Região sobre o direito à saúde na área das neoplasias no ano de 2022, especialmente quanto à prova dos fatos afirmados no processo e à decisão correspondente. Foi realizada busca em jurisprudência, entre os meses de março e abril de 2023, no site do tribunal, sendo identificados 403 acórdãos para o período de janeiro a dezembro de 2022. Desse total, 361 ações judiciais versaram sobre fornecimento de medicamentos antineoplásicos (89,58%). Relacionados aos elementos da prova, foram analisados especificamente os 361 acórdãos referentes à solicitação de medicamentos antineoplásicos. Quanto à perícia prévia, 194 (53,74%) das 361 ações judiciais de medicamentos antineoplásicos continham o entendimento de que esta poderia ser substituída quando a pessoa estava em tratamento em Unidades de Alta Complexidade em Oncologia/ Centros de Alta Complexidade em Oncologia, por parecer técnico do Núcleo de Apoio Técnico do Poder Judiciário ou decisão favorável de incorporação do medicamento pela Comissão Nacional de Incorporação de Tecnologias no Sistema Único de Saúde. Desses 194 processos, em 185 (95,36%) havia solicitação de tutela antecipada. Conclui-se que o tema da judicialização da saúde permanecerá na pauta do Poder Judiciário, seja pela exigibilidade judicial, seja pela necessidade do entendimento do papel do Estado na efetivação das políticas públicas. Assim, faz-se necessário fortalecer a construção de agendas, conjuntas e permanentes, entre os poderes e a sociedade civil para o entendimento e o enfrentamento desse fenômeno.

Este trabajo tuvo como objetivo presentar las normas oncopediátricas vigentes en la República Argentina tanto a nivel nacional como provincial, a partir de un abordaje cronológico respecto de su evolución y un análisis comparativo de los criterios comunes que presentan. La sanción de la Ley Nacional 27674 constituye un hito de significativa impor tancia en la materia. A su vez, existen normas sobre oncopediatría en catorce provincias (Buenos Aires, Chaco, Chubut, Córdoba, Corrientes, Entre Ríos, La Pampa, Mendoza, Misiones, Río Negro, Salta, San Juan, Tierra del Fuego y Tucumán), mientras que hay nueve provincias (Catamarca, Formosa, Jujuy, La Rioja, Neuquén, San Luis, Santa Cruz, Santa Fe y Santiago del Estero, con más la Ciudad Autónoma de Buenos Aires) que no han abordado el tema en ámbito normativo, estas no cuentan con regulación explícita en materia de CP pediátricos o normas de oncopediatría. Aun así, las normas de once provincias (Río Negro, Entre Ríos, Tucumán, Salta, Chaco, Misiones, Río Negro, Mendoza, San Juan, Corrientes y Chubut) son los antecedentes de la sanción de la Ley Nacional la cual registra la adhesión de diez provincias (Chaco, Tierra del Fuego, Misiones, Tucumán, Chubut, Salta, La Pampa, Buenos Aires, Corrientes y Córdoba).
As consultas públicas são um mecanismo de participação social no processo de regulamentação, caracterizadas pelo discurso da garantia da eficácia dos resultados e para promover a democratização do processo e atender a interesses capitalistas. À Agência Nacional de Vigilância Sanitária cabe controlar o risco sanitário de uma série de produtos e serviços, constituindo uma ação de saúde e um instrumento de organização econômica da sociedade em um espaço de disputa de interesses. Este artigo é uma análise documental, que tem como objetivo investigar os atributos e os processos de desenvolvimento das consultas públicas da Agência Nacional de Vigilância Sanitária, de janeiro/1999 a abril/2023. Os documentos encontrados foram categorizados em quatro grupos: legislação específica, relatórios e publicações da agência, relatórios e publicações do Palácio do Planalto e evidências científicas. Foram coletados 654 documentos e evidências, selecionados 350 para leitura de texto completo e extraídos dados de 50 referências. A institucionalização dos procedimentos de melhoria da qualidade regulatória em normas internas, impulsionadas ou não por força de lei e decretos, foi fundamental para estabelecer padrões para publicidade, transparência, prazos e formas de contribuições às consultas públicas, corroborando com evidências de avanços normativos e de desempenho institucional em favor da participação social em espaços decisórios técnicos. Observou-se ainda que um contexto favorável no governo federal decorreu de publicações de normas relacionadas às boas práticas regulatórias na agência em 2008, 2018 e 2021, consolidando institucionalmente as consultas públicas como prática de participação social na normatização sanitária. Entretanto, a participação social nessas consultas é desigual e a diversidade de mecanismos de engajamento na regulamentação pode favorecer grupos com maior poder de organização. Em conclusão, entende-se que são necessários investimentos em iniciativas de educação, enquanto mediadora da participação qualificada, propulsora de consciência política cidadã, poderosa habilidade para democratizar a regulação do risco sanitário.
A formação ética, bioética e jurídica dos profissionais de medicina é um assunto de grande importância para que esses profissionais possam prevenir possíveis conflitos éticos, penais, civis, consumeristas e administrativos. Segundo o Código de Ética Médica, tais conflitos podem levar à cassação do exercício profissional e até mesmo resultar em punições nas áreas penal, cível e administrativa. No mundo dos fatos, contudo, observa-se um aumento no número de processos judiciais contra esses profissionais da saúde, que desvela a ocorrência de um fenômeno intitulado judicialização da medicina. Diante desse contexto, e a partir da realidade dos cursos de medicina situados em Fortaleza/CE, propõe-se enfrentar o seguinte questionamento: analisar a possibilidade de o diálogo com o direito, na grade curricular da graduação em medicina, contribuir para uma educação voltada à prevenção de conflitos e da judicialização da medicina na capital cearense. Trata-se de pesquisa bibliográfica e documental, com abordagem qualitativa, realizada por meio do método indutivo. Em sede de resultados, constatou-se que a grade curricular da Universidade de Fortaleza, que se destaca na avaliação do Ministério da Educação e Cultura do Brasil, opta pelo uso da aprendizagem baseada em projetos, que inclui a relação direito-medicina em diferentes disciplinas, de forma transversal, a fim de viabilizar a construção da identidade profissional dos seus estudantes em meio às experiências que promovem o espírito crítico e reflexivo, com o objetivo de formar “protagonistas do exercício de cuidar e curar”.
La crisis política e inestabilidad institucional que atraviesa el Perú, intensificada en el actual periodo de gobierno (2021-2026), puede afectar el ejercicio del poder reglamentario y, en consecuencia, la implementación de las políticas públicas. Esto también puede repercutir en el ejercicio de la función rectora de regulación del Ministerio de Salud. Anteriormente, en varias ocasiones la Defensoría del Pueblo y el Congreso de la República han advertido el incumplimiento en la reglamentación de algunas leyes de salud. El objetivo de este artículo fue analizar el cumplimiento y control de la reglamentación de las leyes y decretos legislativos y de urgencia de salud en el Perú, durante el actual periodo de gobierno. Para ello, se realizó una revisión documental de normas jurídicas y documentos oficiales con relación al proceso reglamentario en salud, emitidos por el Poder Ejecutivo, el Congreso de la República y la Defensoría del Pueblo, entre el 28 de julio de 2021 al 31 de diciembre de 2023. Se encontró que, de las 21 leyes y decretos legislativos de salud promulgadas en dicho periodo, sólo el 14,3% (3) fueron reglamentadas, todas fuera del plazo debido; adicionalmente, se reglamentaron 8 leyes y decretos legislativos de salud que habían sido promulgadas antes de dicho periodo, con un tiempo promedio de reglamentación de 701,5 días, todas fuera del plazo debido. No se evidenció la aplicación de controles institucionalizados específicos y rigurosos en casos de incumplimiento de la reglamentación. Como conclusiones, persiste un alto incumplimiento y retraso prolongado en la reglamentación de las leyes y decretos legislativos de salud, afectando directamente a las personas y su derecho a la salud. Para enfrentar esto, se requiere de un marco legal apropiado sobre el proceso reglamentario, incluyendo el control político y la responsabilidad política, la aplicación de controles institucionalizados más específicos y rigurosos, y el empoderamiento de la sociedad civil organizada.
O direito à saúde no Brasil, definido na Constituição de 1988, é garantido e fortalecido por meio de uma ampla estrutura de participação e controle social. Mudanças estruturais transcendentes, como a transformação digital de muitos aspectos do Sistema Único de Saúde, podem ser poderosas ferramentas de ampliação do acesso e da equidade nos serviços, porém, ao mesmo tempo, podem criar novas exclusões por barreiras geográficas, tecnológicas e de letramento digital. Esta pesquisa buscou explorar, a partir de entrevistas, a visão de representantes do campo do controle social no Sistema Único de Saúde a respeito do processo de transformação digital da saúde. Os resultados mostram que o Programa SUS Digital vem mudando positivamente o acesso aos serviços, mas que a participação social ainda não foi completamente incluída e que a transformação digital é percebida como um processo da gestão com ausência de controle social.
Aid at the end of life and dying includes the use of therapeutic methods or procedures such as palliative care, euthanasia, and assisted suicide. The recognition of these procedures as medical acts is a major point of debate. This article specifically examines the classification of these procedures as medical acts within the legal frameworks of Spain and Colombia. It aims to demonstrate that recognizing aid at the end of life and dying as medical acts involves substantial legal implications, particularly in terms of medical liability and ethical considerations. To analyse the positions in favour and against, a bibliographic review was conducted. Firstly, such methods have been subject to progressive medicalisation because they have mainly occurred in healthcare contexts. Secondly, medical professionals must consider the possibility of allowing patients to die with dignity in order to fulfil their purpose of helping people with serious, incurable bodily injuries, illnesses, and chronic disabling conditions for which there is no possibility of cure or measurable improvement. Finally, when such methods and procedures are considered medical acts within the doctor-patient relationship, certain rights and obligations subject to legal regulations can be established. This is the first time that, in legal dogmatics, medicalisation is linked to medical acts, especially those at the end of life and death. Moreover, medical acts at the end of life and death are associated with a regime of professional and legal liability, making it possible to examine these acts in light of medical liability.
Este artigo teve como propósito analisar, por meio de revisão bibliográfica, como a atuação extrajudicial do Ministério Público contribui para a efetivação da assistência integral à saúde, em tempo razoável, dos pacientes que se encontram em filas de espera para tratamentos eletivos. Utilizando o método dedutivo, o trabalho focou no estudo doutrinário e normativo acerca do Direito Sanitário, diferenciando os níveis de complexidade de tratamentos adotados no Sistema Único de Saúde, bem como, os critérios de classificação de riscos de urgência, emergência e eletividade. Partindo dessa distinção, o estudo mostra que os pacientes eletivos são relativizados em detrimento dos casos urgentes e emergentes, pois são encaminhados a uma fila única de espera, onde aguardam o agendamento de consultas especializadas, cirurgias e exames laboratoriais, sem uma previsão de atendimento. Em razão do lapso temporal, a saúde dos pacientes deteriora-se, o que pode acarretar consequências irreversíveis às suas vidas, contrariando o dever estatal de garantia do direito fundamental. Para tanto, os usuários do sistema buscam o Ministério Público, ente legitimado para atuar em juízo (viés demandista) ou fora dele (viés resolutivo), para coibir o poder público a executar os serviços de saúde. Foi possível concluir que há preferência pela utilização de atos resolutivos, como inquéritos civis, audiências públicas, termos de ajustamento de conduta e conselhos de saúde, para a mediação dos conflitos envolvendo as demandas apresentadas. Concluiu-se ainda que, por meios extrajudiciais, o Ministério Público pode atuar como mediador e auxiliar na criação de estratégias para a efetivação do direito à saúde, em tempo hábil para a recuperação dos pacientes.
The adoption of the European Regulation on Artificial Intelligence last June made the European Union the first market to regulate the implementation and commercialization of artificial intelligence systems. Designed to promote safe and reliable artificial intelligence systems, this regulation has repercussions for economic agents seeking to enter the European market. The medical device sector will be particularly affected by the growing development of smart medical devices that incorporate artificial intelligence solutions. This study aimed to analyze the impact of the European Regulation on Artificial Intelligence in Brazil, highlighting its interactions with the regulation on medical devices, which already imposes certain specific requirements on these devices.
