
Aquest article examina en la pràctica i analitza en el pla teòric la relació entre les segones cambres i el federalisme. Es pregunta quina funció federal s’ha esperat o s’ha pretès que exercissin les segones cambres; quina funció han exercit; quina funció podrien exercir, i què cal perquè exerceixin una funció federal útil. Per respondre a aquestes preguntes, l’article analitza l’experiència de les segones cambres federals arreu del món federal i en descriu els trets de disseny. Segons alguns autors, la representació en una segona cambra és una característica definidora o un element essencial dels sistemes federals; d’altres, en canvi, la consideren pràcticament supèrflua. Una visió intermèdia sosté que unes segones cambres ben dissenyades són, com a mínim, desitjables, ja que poden reforçar i protegir el caràcter federal del sistema en garantir un cert grau de codeterminació en la presa de decisions del govern central. Després d’avaluar cadascuna d’aquestes perspectives, l’article conclou que la relació entre el bicameralisme i el federalisme és pràcticament accessòria i sorprenentment mal entesa.
Tot i que la Constitució espanyola defineix el Senat com la “cambra de representació territorial”, aquesta institució presenta profundes deficiències que impedeixen materialitzar aquesta aspiració constitucional. En aquest article, analitzem aquestes deficiències des d’una perspectiva juridicoconstitucional i política. Comencem analitzant els problemes de disseny constitucional, incloent-hi les normes de composició del Senat, les seves competències i la regulació de l’ús de les llengües minoritàries dins de la cambra. A continuació, situem el Senat en el context polític més ampli i mostrem com els defectes de disseny es veuen agreujats per la pràctica política de la institució. Particularment, el domini sostingut del Partit Popular en el si de la cambra —un partit que manté una posició força escèptica envers la descentralització de l’Estat— ha debilitat encara més la funció territorial del Senat. Aquesta situació es veu reforçada per una manca general de coneixement i de confiança de la ciutadania respecte de la institució. També posem de manifest que les deficiències del Senat tenen efectes col·laterals importants sobre altres elements del sistema constitucional, especialment pel que fa als nomenaments dels magistrats del Tribunal Constitucional i al procediment de reforma constitucional. Finalment, analitzem possibles vies de reforma. Tot i que és poc probable que es produeixi una reforma profunda del Senat a curt termini, ja que requereix una esmena constitucional, suggerim que una reforma del règim lingüístic de la institució podria constituir un pas factible i benvingut en la direcció adequada.
Les teories del federalisme emfatitzen la importància de les cambres altes com a espais de representació de les unitats constituents i, per tant, d’exercici del govern compartit. El Canadà, una federació paradigmàtica, no disposa d’aquest tipus de cambra alta, ja que el seu Senat, els membres del qual no són electes, no pot actuar en representació de les províncies. Tot i això, en el context d’aquesta incapacitat d’oferir representació provincial, el Senat sembla haver desenvolupat una funció alternativa de representació d’altres tipus de comunitats polítiques del país, concretament, les comunitats de llengua oficial i els pobles indígenes. Aquest article analitza la paradoxa de la cambra alta d’una federació consolidada que va ser concebuda per proporcionar representació territorial però que no compleix part del seu mandat original. S’hi estudia com les deficiències del Senat han fet que esdevingui l’objecte de propostes de reforma i el blanc de les polítiques d’alienació occidental. Així mateix, l’article documenta i analitza com i fins a quin punt el Senat ha evolucionat cap a una funció de representació de dos tipus diferents de comunitats marginades dins la federació: els francòfons de fora del Quebec i els pobles indígenes.
D’una banda, el paper institucional d’una segona cambra en una federació és proporcionar una representació regional igualitària en el parlament federal. D’altra banda, la funció principal d’una segona cambra federal és vehicular els interessos de les entitats federades en l’àmbit federal. En primer terme, aquest estudi examina la raó de ser i el paper de les segones cambres com a cambres territorials o regionals en els estats federals. Així mateix, analitza el marc conceptual per explicar la complexitat i avaluar la força institucional de les segones cambres federals. A continuació, descriu la relació entre dues variables de les segones cambres (les competències i la composició) i la seva força institucional com a representant de les entitats federades. També explica el paper de l’entorn institucional més ampli en què operen les segones cambres. Finalment, descriu les consideracions metodològiques que permeten mesurar fins a quin punt una segona cambra exerceix la seva funció com a cambra regional; en aquest cas, el Senat del Pakistan. L’article s’estructura en tres seccions: la primera estudia la relació entre federalisme i bicameralisme; la segona proposa un marc conceptual per estudiar l’entorn institucional més ampli en què operen les segones cambres, i la tercera aplica aquest marc conceptual al Senat del Pakistan i el situa institucionalment dins del conjunt de les relacions intergovernamentals.
El text analitza el paper de les segones cambres (senats) en els sistemes federals contemporanis. Tot i que tradicionalment es consideren essencials per garantir la participació dels territoris en la presa de decisions federals (“shared rule”), l’evidència mostra que sovint actuen més com a espais de competició partidista o de revisió legislativa que no pas com a veritables representants dels territoris. Els autors argumenten que aquest debat s’ha plantejat de manera inadequada perquè s’ha prestat molta més atenció a l’autonomia territorial (“self-rule”) que als mecanismes de participació compartida. Des de la perspectiva del federalisme multinacional, les segones cambres haurien de servir per reconèixer les diferents nacions o comunitats polítiques, garantir-ne la participació efectiva i reforçar la legitimitat de la convivència federal. Per això, proposen diverses hipòtesis sobre com haurien de funcionar aquestes institucions i conclouen que les segones cambres no són ni garants automàtiques del federalisme ni institucions obsoletes. Més aviat, han estat mal interpretades, i cal repensar-ne el paper dins dels sistemes federals actuals, especialment en contextos multinacionals.
El Senat neerlandès, un vestigi de la unió del segle xix entre els Països Baixos i Bèlgica, continua sent una institució «residual» en un estat unitari però descentralitzat. La seva elecció indirecta a través de les assemblees provincials li confereix un paper territorial limitat, i són freqüents els debats sobre la seva legitimitat i rellevància democràtiques. La Cambra dels Pobles de Bòsnia i Hercegovina, en canvi, té la responsabilitat de mantenir el fràgil equilibri etnonacional del país. Creada per la Constitució de Dayton, que estableix un complex marc federal, atorga als pobles constituents de Bòsnia i Hercegovina poders de representació i veto, mecanismes que ajuden a evitar la dominació d’uns pobles sobre els altres, però que també contribueixen a l’estancament polític i reforcen la divisió. Els Emirats Àrabs Units ofereixen una tercera configuració, en què el Consell Nacional Federal funciona com un equivalent institucional consultiu d’una segona cambra dins d’un sistema federal dominat pel consens entre elits. L’article compara aquests diferents dissenys institucionals per examinar com les segones cambres, fora dels models federals clàssics, gestionen les tensions entre legitimitat i eficàcia. Mitjançant una anàlisi comparada dels llegats històrics, del disseny institucional i dels debats de reforma, s’argumenta que aquestes institucions no persisteixen perquè gestionin eficaçment la diversitat, sinó perquè contribueixen simbòlicament a l’estabilitat constitucional en sistemes complexos multinivell.
Els vint-i-un anys de govern de l’AKP a Turquia sovint s’atribueixen a factors com les tensions entre laïcitat i religió, la mobilització efectiva dels votants i les presumptes manipulacions electorals. Tanmateix, aquestes explicacions passen per alt factors sistèmics que afavoreixen el predomini d’un partit hegemònic, especialment l’elevat grau de centralització. Aquest article analitza com la centralització i la descentralització configuren els paisatges polítics, tot establint comparacions amb altres estats unitaris i descentralitzats, abans de centrar-se en el sistema polític turc. L’anàlisi mostra com la centralització i unes lleis de partits restrictives concentren el poder a Ankara, fet que permet que els partits governants, com l’AKP, dominin sense contrapoders locals efectius. A conseqüència, tots els partits polítics es veuen obligats a adoptar discursos nacionalitzats, cosa que provoca una desconnexió amb els electors locals i incrementa el risc de conflictes socials i polítics. L’article suggereix que un gir cap a la descentralització podria alleujar algunes d’aquestes tensions, afavorint una representació més inclusiva i reduint la influència desproporcionada del govern central.
Un dels principals arguments esgrimits a favor de les segones cambres i el bicameralisme és que garanteixen la representació i la participació de les regions, així com la protecció de les minories, dins de les institucions centrals d’una federació. Tanmateix, aquest vincle entre el federalisme i el bicameralisme podria ser més feble del que s’ha cregut fins ara. Des d’una perspectiva empírica, són poques les segones cambres que representen eficaçment els interessos regionals. Des del punt de vista teòric, mentre que alguns autors consideren les segones cambres com una característica essencial de les federacions, d’altres en qüestionen la importància tant per als estats federals com per a la nostra concepció del govern compartit. Aquesta discrepància planteja qüestions importants per als teòrics del multinacionalisme: quin lloc haurien d’ocupar les segones cambres en el projecte multinacional? Sense pretendre resoldre aquesta qüestió, argumentaré que les segones cambres contribueixen a elucidar les tensions entre dues maneres d’entendre el projecte normatiu associat al federalisme multinacional: un projecte orientat a la protecció de les minories nacionals i un projecte orientat a l’empoderament dels pobles. Tot i que aquests dos projectes convergeixen en la qüestió de l’autonomia, donen lloc a recomanacions i interpretacions diferents del paper, les competències i la importància de les segones cambres en el context federal.
Més d’un terç de les constitucions actuals estableixen un parlament bicameral. Tanmateix, la institució d’una segona cambra té una història força més llarga que el constitucionalisme modern: arrelades en antigues assemblees elitistes, les segones cambres deuen el seu disseny predominant al concepte de federalisme. Gairebé totes les constitucions federals preveuen, doncs, una segona cambra concebuda com un vincle institucionalitzat entre les unitats constituents i el nivell federal. Però malgrat la seva associació clàssica amb el govern compartit, les segones cambres federals rarament compleixen aquesta promesa. Això es deu principalment a competències deficients o a una representació política ineficient, tot i que la seva legitimitat democràtica les distingeix d’altres segones cambres que són objecte de crítiques més generals a les estructures bicamerals. Mentre que alguns proposen mecanismes alternatius de representació territorial, d’altres neguen completament la necessitat de les segones cambres per al federalisme. Tot i això, la necessitat que les unitats constituents participin formalment en la presa de decisions federals no es pot substituir fàcilment. Atès que les segones cambres federals varien considerablement pel que fa a la seva composició, el nomenament dels seus membres i les seves funcions, l’article n’examinarà el potencial i els límits des d’una perspectiva comparada. Si bé tradicionalment s’ha centrat l’atenció en el paper extern de les segones cambres federals respecte d’altres institucions, no es pot oblidar la dimensió horitzontal dins d’aquestes cambres; és a dir, la manera com les unitats constituents estan representades i com es duu a terme la presa de decisions interna.
El monogràfic d'aquest número estudia el paper dels senats i les segones cambres en els sistemes federals. Parteix de la idea que el senat, consolidat com a institució clau del federalisme des de la Constitució dels Estats Units, ha estat tradicionalment considerat un instrument de govern compartit entre territoris. Tanmateix, molts senats són criticats perquè no representen realment els territoris. El renovat interès acadèmic i polític per aquest tema, s'exemplifica pel debat internacional sobre el federalisme, la proposta d’abolició del Senat a Bèlgica i les discussions sobre la reforma o supressió del Senat espanyol. El monogràfic reuneix set estudis de perspectives diverses per analitzar si les segones cambres poden actuar com a espais efectius de representació territorial i codeterminació. Finalment, es presenta l’equip coordinador i els autors participants, es destaca la vocació internacional de la revista i s’anuncia una nova etapa en la seva direcció, coincidint amb el seu vintè aniversari.
Since the reestablishment of the constitutional state in Spain, in 1978, we have witnessed a process, still incomplete, that seeks to adapt the organization and management of the migration phenomenon, in all its facets, to the complex reality represented by the current model of territorial organization of the State. In this regard, it has been necessary to overcome the resistance raised by an interpretation according to which the Constitution considered immigration and foreigners to be matters subject to the exclusive jurisdiction of the State, ignoring the fact that its content affects multiple sectors of public activity, which fall under the jurisdiction of the autonomous communities, also provided for in the Fundamental Law itself. This has gradually led to a distribution of intervention powers, both regulatory and administrative, which, while varying in intensity, in any case prevents the State from implementing comprehensive regulations, excluding any autonomous community intervention, in relation to such matters. In this context of establishing a more balanced regulatory framework, attentive to the safeguarding of the respective interests of the State and the Autonomous Communities, a Proposal for an Organic Law was registered in the Congress of Deputies for the delegation of state powers in matters of immigration to the Autonomous Community of Catalonia, which, based on respect for a remainder of state powers in relation to a matter in which the State concurs, represents a further step in the delimitation that the legislation, the Statutes of Autonomy and constitutional jurisprudence have been outlining, which cannot be considered exhausted or definitive, given the continuous need to adapt it to new demands, either of deepening self-government, or of bringing management closer to the citizen and improving administrative efficiency. Hence, it promotes developments that do not contradict express constitutional precepts, and which, since they represent an improvement and simplification in management, should be considered desirable for them to be extended to those Autonomous Communities that have similar interests in this regard.
This article explores the competences of the Generalitat of Catalonia in relation to immigration—a responsibility traditionally reserved for sovereign states—from both legal and contextual perspectives. While it begins by outlining the framework established in the 1979 Statute of Autonomy, its primary focus is on the competences recognised in the 2006 Statute, relevant Constitutional Court jurisprudence, and the practical exercise of these competences in recent years. It also examines the failed draft organic law, launched in the Congress in March 2025, which proposed the delegation of additional competences to the Generalitat. Taken together, these elements underscore the importance not only of assessing the content and scope of the Generalitat’s competences, but also of understanding the broader conditions that determine whether these powers lead to more effective policies and improved outcomes for migrants.
This paper, entitled Policies, government programmes and regulations affecting immigration in Catalonia, aims to analyse the main public measures being implemented by the Government of Catalonia in accordance with its powers in the field of immigration. This study begins with a review of the policies and regulations that have been adopted in Catalonia since the beginning of this century, which have already shown a significant trend towards addressing the link between migratory movements and the labour market. The second section of the study focuses specifically on the programmes adopted by the Department of Enterprise and Labour related to promoting the integration of the immigrant population into employment in Catalonia. The third and final chapter addresses the new structure that has been created in the other Department of Catalan Government with powers in the field of immigration, the Department of Social Rights and Inclusion, and the attribution of functions affecting migrants to its entities. Among other conclusions, it must be confirmed that the Government of Catalonia must continue along the way of employability for foreign nationals, offering solutions to those who are in an irregular situation, and view its bodies with powers in immigration as executors of its own policies for immigrants.
The article analyzes the regulatory evolution of the Spanish legal framework on asylum and immigration, with particular reference to Organic Law 4/2000 of 11 January on the Rights and Freedoms of Foreigners in Spain and their Social Integration (LODYLE), and Law 12/2009 of 30 October regulating the Right to Asylum and Subsidiary Protection (Asylum Law). It examines how constitutional jurisprudence has influenced this evolution, shaping both the interpretation and practical application of these norms. The analysis demonstrates that the distinctive features of Spain’s current immigration regime can be traced back to the significant regulatory shift initiated in the early 2000s. Two elements emerge as defining characteristics. First, the increasing interdependence between the supranational migration framework designed within the European Union and Spain’s domestic legal order, which has progressively narrowed the scope of autonomous national policymaking. Second, the complexity inherent in the development and implementation of migration policies at the national level, largely attributable to the asymmetrical territorial distribution of competences, which reflects the challenges of managing integration processes in a decentralized state.
This article analyses the doctrine of the Supreme Court of Canada in its opinion on the secession of Quebec, as a key reference for the democratic management of territorial conflicts. Despite what some secessionist readings suggest, the referendum does not occupy the core of the Canadian model; rather, it represents just one stage within a decision-making procedure whose complexity is what ultimately proves decisive. It is within this complex framework that Parliament appears to hold a central role. Drawing on a close reading of the texts articulating this doctrine, the article assesses the role assigned to Parliament and its implications for the shaping of constitutional democracy. The article is organized into two sections: the first examines the referendum as a mechanism for resolving territorial conflicts; the second focuses on the role of parliament within the democratic balance. It concludes, on the one hand, that the legitimacy of deeply divisive decisions is linked to the procedural costs entailed in reaching them; and on the other, that this doctrine calls for qualifying the liberal fiction of a single people with a general will, and instead points toward a more complex understanding of democracy that combines majority rule with mechanisms of consensus.
Although the Basque Country’s context cannot be directly compared—either quantitatively or qualitatively—with that of other autonomous communities or municipalities in Spain experiencing greater migratory pressure, the development of its autonomous competences, and particularly the evolution of its strategic plans over the past decade, have positioned it as a reference case in regional and local governance. Over this period, the Basque autonomous government has implemented a distinctive reception model alongside an intercultural coexistence framework that systematically addresses the needs of a diverse foreign-born population.This article examines the specific allocation of competences across the historical territories of the Basque Country and analyses selected practices in the governance of reception and integration at both regional and local levels. These include the Basque Government’s Auzolana community sponsorship programme, the Basque model for managing reception during the autonomy phase, the Provincial Council of Bizkaia’s Goihabe programme, and the recently launched Harreragune pilot project. These initiatives exhibit some overlap in objectives and spheres of intervention, they collectively constitute complementary and mutually reinforcing policy mechanisms. Together, they enhance the multilevel governance of reception and integration processes for migrants and refugees and illustrate the capacity of a regional government with significant autonomous powers to design and implement context-specific, coordinated, and innovative policy solutions within a decentralized institutional framework.
An adequate migration strategy necessarily hinges on multilevel governance, from the EU and the central State to regional authorities and cities. The Autonomous Communities have a key—and growing—role to play in the management of migration, and in particular in the integration of new groups of people. The Autonomous Community of Andalusia, due to its geographical singularity, has a privileged position for the study of the migratory phenomenon. The research carried out is necessarily structured around three aspects. Firstly, a diagnosis of the reality, through an approach to the characteristics of the foreign population in Andalusia. Secondly, the research focuses on the legislative context and, specifically, the functions of the Autonomous Communities within the Spanish constitutional framework and their role in the European integration policy. This is followed by an analysis of the strategies of the Autonomous Community of Andalusia in the field of migration, the starting point of which are the competences assumed following the 2007 statutory reform. Finally, it looks in depth at the governance and planning carried out by the Andalusian autonomous government over the last two decades, from the Comprehensive Plans (2000-2020) to the Andalusian Strategy for Immigration (2021-2025).
The process of climate change that is taking place on our planet, with obvious manifestations in the Mediterranean region, causes alterations in the main climatic elements (temperature, precipitation) and, in particular, favours the more frequent occurrence of extreme atmospheric events, which have a significant socio-economic impact in the affected regions. This paper presents the existing reality of climate change in our country, addresses the difference between meteorological warnings and civil protection alerts, advocates the comprehensive management of disaster risk as a tool for risk reduction and provides some guidelines for adaptation to climate change and its associated atmospheric extremes in the Mediterranean regions. application.
In Bolivia, indigenous grassroots organisations have developed a historical journey for territorial restoration and the establishment of their autonomy. This qualitative, descriptive, multiple-case comparative study, carried out in two indigenous towns in Bolivia – Charagua (Chaco-Guarani) and San Pedro de Totora Marka (Altiplano-Aymara) –, gives an account of the process carried out by their respective grassroots organisations and their systematic struggle and orientation towards territorial recovery and the establishment of their own governments. Both communities began and completed their process of conversion to self-government on the same date and under the same procedures, although the results were dissimilar: Charagua accepted its conversion and Totora rejected it. The analysis reveals the multiple tensions, struggles and agreements of the original grassroots organisations as promoters and mediators of the achievement of – or resistance to – autonomy, thanks to the exploitation or undermining of the structures of identity and political and governmental opportunities. At the same time, these organisations are presented as the appropriate instruments for the connection between identity-territoriality and State power.
