Problem setting. The challenge is to significantly accelerate transformational changes through a double transition (digital and green) to Industry 5.0. Analysis of recent researches and publications. Akundi, A., analyzed the state of Industry 5.0 and identified current research trends, Massaro, A., examined advanced management systems in Industry 5.0 that facilitate technological mining Maddikunta, P. and a group of scientists conducted a survey on the technologies and potential applications of Industry 5.0, Gagnidze, I. At the systemic level, he determined whether clusters can cope with the challenges of Industry 4.0 and Industry 5.0, which is also the task of the European Commission and the Manifesto on the double transition in Ukraine. Target of the research. Development of theoretical provisions and practical recommendations for determining the role and importance of Industry 5.0 for the double transition to accelerate the transformation of innovation development. Article’s main body. Priority topics are highlighted, including innovation and digitization, production sustainability, its transformation, and the connection between man and machine. An essential characteristic of the changes that are taking place under the influence of the double transition to Industry 5.0 is the provision of an innovative approach to model-based production management in industry, the introduction of a new concept of advanced process analysis that automates decision-making and optimizes machine settings. According to the European Commission, Industry 5.0 is a key driver of economic and social change, and should lead a double transition: digital and environmental. To determine the level of interest in the transformational changes in innovative development in the context of Industry 5.0, the article uses the Google Trends search service, which provides statistics on interest in several topics simultaneously in space and time. The article conducts a Google Trends search for the topics "Industry 5.0", "European integration", "transformation", "innovative development", "cluster" in Ukraine for the last 12 months (as of August 27, 2023), highlighting the average level of interest and priority regions. The search for the topic of Industry 5.0 in Ukraine over the past year is statistically insignificant. The greatest interest was shown in the cluster and transformation topics, followed by the European integration topic, and the lowest level of interest in innovative development, which is a negative factor. The composition of the priority regions in terms of the identified topics differs: the topic of European integration is more interesting in the western regions of Ukraine, the topic of transformation is more interesting in the central part, and the topic of clusters is interesting in all regions. Conclusions and prospects for the development. The special legal period of martial law is restrictive, which negatively affects the ability to use changes in the technologies of both circular Industry 4.0 and Industry 5.0, but in the current conditions of European integration, on the other hand, there should be an accelerated push for the development of the circular economy. The formation of transformational changes in innovative development in the context of the formation of Industry 5.0 is extremely important in the reconstruction of destroyed industrial enterprises and infrastructure. Post-war recovery requires tools to coordinate stakeholders interested in implementing Industry 5.0 dual transition technologies to strengthen European integration. At the national level, Ukraine needs to focus on the tasks of the double transition to Industry 5.0 by stimulating the development of clusters using European experience.
The purpose of this article is to analyze the functioning of the multilateral projects of the «Horizon 2020» and «Horizon Europe» Programs, to establish the peculiarities of the status and activities of their subjects. To achieve the goal of the scientific work and solve the set tasks, a complex of general scientific and special research methods was used: the method of analysis and synthesis, alternatives, comparative studies, classification. Research on this issue allows us to state that despite the fact that multilateral Horizon 2020 projects constitute a significant part of EU project funding, scientific research on this issue is insufficient. This is partly due to the lack of a structured analytical approach of the subjects of this Framework Program. In particular, the legal status of the National Contact Point, which provides informational and methodical support for the thematic areas of research determined by the European Commission (EC) for the EU research and innovation program «Horizon Europe», remains overlooked. Within the framework of this study, the experience of Poland, where there is a Polish National Contact Point for EU research programs, was introduced. It was determined that at the micro-level of IS there is a Program «Horizon 2020» or «Horizon Europe», which can act as projects (a network of participants who cooperate within the framework of a joint innovation project both at the national level and at the EU level) and as Partners (organization, consisting of a network or group of persons, or an individual participant, who cooperate within the framework of a joint innovation project both at the national level and at the EU level) is a certain level of the very structure of a multi-level innovation system (or IS of a higher level). The authors propose to make changes to the Law of Ukraine on Scientific and Scientific-Technical Activities. So, there is a proposal to add par. 3 to art. 66 regarding the status of a scientific institution that can act as a basic organization in which the National Contact Point of the European Union Framework Program for Research and Innovation «Horizon Europe» has been established.
The article assesses the prospects for the development of entrepreneurial activity in the EU and Ukraine in the conditions of digitalization of the economy. A methodical approach for the analysis of the development of entrepreneurial activity in the EU countries and Ukraine in the context of the digitalization of the economy has been formed, which consists of three stages. Attention is drawn to the fact that the WDCR, NRI, GII indices combine mainly institutional, economic and technological indicators that reflect the development of regulatory and legal research base, use of ICT in business, information security. The EGDI index has a more social orientation and reflects socio-economic integration - it is designed to assess the level of development of the information society. An analysis of the dynamics of changes in entrepreneurial activity in EU countries and Ukraine in the conditions of digitalization of the economy was carried out. It was established that despite the lower level of development of digitalization in Ukraine compared to the EU countries, the development trends both in the EU as a whole and in Ukraine clearly coincide. The impact of the digital component on the development of entrepreneurial activity in EU countries and Ukraine was modeled using correlation-regression analysis. It was noted that the level of digitalization does not affect the speed of the legislative body's reaction to eliminate the deterioration of the conditions of business activity, and the establishment of index indicators only according to the adopted normative legal acts does not take into account the effectiveness of the implementation of legislative changes in the field of business activity. It was concluded that among the three variables, the e-government development index has the greatest influence on the development of entrepreneurial activity. Belgium, Croatia, Italy, Slovakia, Luxembourg, the Netherlands, and Hungary have the greatest direct relationship between the development of entrepreneurial activity, the digital government development index, and digital competitiveness.
Problem setting. The concept of post -industrial society implies that the economy of modern states should prevail in the innovation sector with high -yielding industry, knowledge industry and high proportion in GDP of high -tech and innovative services. In this approach, information is considered by a separate full -fledged resource, which not only does not infer the traditional material resources, but may also be more important. The development of the economy in the realities of post -industrial society requires the creation of favorable conditions for the activity of competitive innovative enterprises, many of which begin as startups and SMEs. At the same time, such enterprises require significant individual information support and support. In order to understand what support can be calculated by representatives of the domestic innovation sphere, it is advisable to inspect and compare the services that contribute to their information support. One of the varieties of such services is information and communication platforms. Analysis of resent researches and publications. The roles of startups, SMEs and innovative infrastructure in modern society are devoted to many works of employees of the Research Institute of Providing Legal Framework for the Innovative Development, in S. V. Hlibko, D. S. Korytin, I. V. Podrez-Riapolova, M. H. Khaustova et al. Among the domestic scientists involved in the issues of information and communication technologies and systems, it is possible to distinguish K. O. Bezuhla, P. M. Lissov, P. P. Maslianko. Purpose of the research is to carry out inspection and comparison of services that contribute to information support (with emphasis A of information and communication platforms), in order to cover the support of startups, SMEs and other persons who directly and indirectly contribute to the development of the domestic competitive economy. Article’s main body. Scientific work examines and compare services that contribute to information provision of innovation (business activity of innovative subjects). Special emphasis is placed on information and communication platforms, in particular on the development of the Scientific and Research Institute of Providing Legal Framework for the Innovative Development – Smart Law Innovation platform (SLI). The definition and classification of infocommunication systems, which allows you to outline the essence of Smart Law Innovation, is given. The article pays attention to the importance of information for building a modern competitive economy in the postindustrial world. While innovative activity is a prerequisite for the described development, information support is an important condition for the activity of innovative entities. The article emphasizes the importance of information support (information and counseling) of startups and SMEs, which bring a significant share to the innovative development of successful countries, but require special support for launching, developing and avoiding risk. Enterprise Europe Network and its regional centers (on the example of the Polish Center Podlaska Fundacja Rozwoju Regionalnego) are explored to analyze the EU’s positive experience in the field of business. Services provided by the domestic network of business support centers, formed for the financing of the European Union under the EU4Business initiative during 2016-2020, are paying attention to a positive trend to the formation of online online communities providing online services. Services offered by platforms are performed. Attention is paid to powerful positive experiences and powerful sides that can offer outlined services. The final part of the article is devoted to the inspection of the information and communication platform of the Smart Law Innovation and its comparison with the existing concrete proposals outlined above. Conclusions and prospects for the development. The development of innovative enterprises is a prerequisite for building a competitive economy in the post-industrial world. At the same time, information support is an important condition for launching, developing and avoiding risks. The importance of timely information and counseling is especially noticeable for startups and SMEs, which bring a significant share in the innovative development of successful countries. Proper use of electronic technologies and the development of infrastructure capable of assisting innovative entities can significantly contribute to Ukraine’s economic reconstruction. Further analysis of the EU’s positive experience, including Enterprise Europe Network, can be used to increase favorable business conditions in Ukraine. In addition to state support, the article draws attention to private projects that provide information support and counseling, including online services, formed by lawyers and individual consulting projects. One of the projects that provides information support for innovative subjects, researchers and ordinary citizens is the Smart Law Innovation Information and Communication Platform, developed by the Research Institute of Legal Support of Innovative Development of the National Academy of Sciences of Ukraine. Although the platform is still under development, the analysis of competitive proposals allows you to see a number of advantages over this development.
The article deals with the application of morphological analysis of text processing to solve the problems of individualization of card services for bank customers. The level of interest in this linguistic tool in Ukraine and the world was determined using the Google Trends service. Based on a customer survey, a morphological analysis was conducted regarding personalizing the bank's card services. The results empirically determined the priority of forming loyalty programs, for example, a combination of criteria for choosing non-financial card product services and options for client settings. It is proposed to deepen the application of methods of using linguistic systems in the banking sphere through the introduction of the morphological analysis algorithm and automated decision-making products. A possible option for implementing a decision on the selection of card services through the Decision-Making Helper program is presented, making it possible to speed up the data processing process and consider the client's individual needs more effectively.
In the current context of the development of the world economy, one of the main priorities of the country’s economic development is the intensification of investment processes, because they have a positive impact on economic growth and efficient functioning of a country’s economy. The modern investment market is full of competition among countries in order to attract investment. The main indicator influencing the amount of funds raised in the country’s economy is the country’s investment climate. Also, in modern conditions the concept of “green” economy is actively promoted. Therefore, today the assessment of the investment climate of the EU countries and Ukraine in the implementation of the “green” economy is a very important and relevant issue. Finding ways to improve the investment climate in Ukraine is another topical issue. The main objective of this study is to assess the investment climate of the EU countries and Ukraine under conditions of realization of the “green” economy. The research uses general scientific methods of cognition: induction and deduction, analysis and synthesis, methods of qualitative and quantitative economic and statistical analysis, graphic method. Among the methods of economic-mathematical modelling, correlation analysis, trend analysis and correlationregression analysis were used. It was established that the study of the investment climate of the EU countries and Ukraine in the context of the implementation of the “green” economy is based on objective international ratings that have a transparent calculation methodology. These international ratings are constantly updated and cover most countries of the world. So, the proposed method makes it possible to conduct an analysis of the investment climate and the “environmental friendliness” of the country’s economy according to world indices, to determine which countries are leaders and which are outsiders according to the selected indices and indicators, to study the place of Ukraine according to these indicators, and to conduct a trend analysis, to model the degree of close relationship between indices and factors of the investment climate on the basis of correlation analysis, as well as to develop recommendations for improving the investment climate of the EU countries and Ukraine in the conditions of implementation of the “green” economy
Modern trends in the use of information and communication technologies to ensure the financial security of economic entities were determined. The distribution of a large sample of enterprises by industry according to the level of financial security (on the verge of bankruptcy, stable and financially stable) using the Altman model was proposed. The potential of using mechanical trading systems within the scope of investment activities on virtual asset exchanges by domestic enterprises in order to increase profit as a component of the Altman coefficient was revealed. The hypothesis was proposed and confirmed: a positive impact on the company’s profit leads to an increase in the level of its financial security. The effectiveness of using a trading strategy based on the commodity channel index was proved through the simulation of trades in virtual assets on a selected fragment of retrospective data using the developed mechanical trading system. The advantages of managing the financial security of enterprises using the proposed info-communication components of mechanical trading systems was demonstrated.
Problem setting. A properly functioning banking system that facilitates the provision of modern banking services, which is ensured by effective national legislation and its harmonization with EU law, can be considered a necessary prerequisite for the economic stability of any modern state. However, the effectiveness of legal regulation cannot be achieved without a clear understanding of the essence of the object of regulation and the instruments of influence on it, the place of banking regulation in the reforming and post-war restored economy of Ukraine, including in the conditions of modern regulatory mechanisms, such as Industry 4.0. Analysis of recent researches and publications. In recent years, the problems of legal regulation of banking operations have been dealt with by scientists from various fields of science and law, which corresponded to the current challenges of the time of conducting research. During the formation of banking law and legislation in Ukraine, the concepts of banking services and operations were mostly provided by Ukrainian scientists, in particular such as I. A. Bezkluby, O. O. Kachan, I. L. Nurzad, O. P. Orlyuk, most often on on the basis of a functional and substantive analysis or on formally legal grounds of the legislative definition of banking activity. Zh. O. Andriichenko, I. M. Chmutova drew attention to the development of the banking supervision system for banking operations based on a risk-oriented approach, the reliability of Ukrainian banks and their ability to resist the risks of money laundering. Bank payment services to be investigated by V.P. Bohun, I. M. Zhukov, S. M. Polovko, defining their content and tasks for improvement. At the same time, in the presence of separate legal concepts of financial services markets, including banking services, directly banking operations and types of banking activity, it becomes necessary to harmonize the legislative regulation of banking activity with the existing mechanisms of state regulation of the economy of Ukraine. Target of the research. In connection with the noted problems, in order to answer the question of the formation of directions for the legal regulation of banking activity and, at the same time, the state policy regarding the transition of the economy to Industry 4.0, the proper performance of the functions of financial intermediation of banks, it is necessary to determine possible tasks for the harmonization of further regulation of banking activity, the provision of financial services with mechanisms for restructuring the functioning of the economy of Ukraine in the conditions of Industry 4.0, as well as to note the trends of approximation of the regulation of banking operations to the requirements of the business environment, taking into account the interests of banks or their clients. Article’s main body. The actual dualism of the regulation of banking activity in Poland performs at least two functions: first, it defines the list of types of purely banking activity, and secondly, it clearly defines that these types of activities constitute the special competence of banks. Similar operations in the Law of Ukraine "On Financial Services", as well as in the Association Agreement between Ukraine, on the one hand, and the European Union, the European Atomic Energy Community and their member states, on the other hand, dated September 6, 2014, and in the Appendix regarding financial services to the General Agreement on Trade in Services (the Protocol on the Accession of Ukraine to the World Trade Organization, ratified by the Law of Ukraine "On the Ratification of the Protocol on the Accession of Ukraine to the World Trade Organization" dated 04/10/2008 No. 250-VI are classified as financial services and have in these normative acts, the substantive identity of the terms given in Directive No. 2013/36/EU for types of financial services, which are worded differently from the terms of these transactions in the Law of Ukraine "On Banks". Conclusions and prospects for the development. It is necessary to deviate from the definition of normative regulation of banking activity: either to remain on the basis of stable normative regulation or to regulate banking activity taking into account modern world trends regarding banking activity and financial services and as markets that contribute to the economic growth of the country. Therefore, there is currently a question regarding the improvement of approaches in accordance with which it is necessary to determine the ratio of modern means of legal regulation of banking activity, their justification and mandatory introduction into the economic and legal mechanisms of Industry 4.0.
Google Trends is a popular computational linguistics tool designed to determine and analyze the range of public interests, taking into account the linguistic features of the formation of Internet queries. In this paper, it is proposed to use the Google Trends service to determine the risks of cooperative ties between industrial enterprises of the Kharkiv and Zaporizhia regions, which are already leaders in industry clustering in Ukraine. The information base of the study was the groups of enterprises, which were determined by the analysis of the hierarchy of cooperation relations. An analysis of the names of enterprises in the group using Google Trends made it possible to determine the demand for their products by region, which made it possible to assess the state of their promising cooperation. In this aspect, a list of clustering risks is defined, a relative assessment of indicators according to the linguistic features of the formation of scales including. The work carried out an experiment with Kharkіv enterprises, which made it possible to make a decision on cooperation with certain institutions, taking into account the processing of qualitative indicators by using linguistic information. Thus, the scientific novelty of the paper is the technology of processing quality information with widespread use of methods of using linguistic information, which is important for the formation of prerequisites for decision-making in economics was developed by the authors.
In the conditions of martial law on the territory of Ukraine there is a need to develop an effective mechanism for exercising the rights of internally displaced persons. The problems of exercising economic rights, in particular, the problems in the field of realization of property rights by internally displaced persons, become especially relevant. The purpose of this article is to analyze research and the main provisions of regulations and draft laws relating to the implementation of economic rights of internally displaced persons. The study of the works of scientists allowed establishing and assessing the state of research of the chosen topic, to identify and investigate the problematic issues that have arisen at the present stage and to identify ways to solve them. In particular, the general problems of protection of the rights of internally displaced persons were outlined, which are the problems of realization of the rights of internally displaced persons of institutionalorganizational, legal and socio-economic nature. Within the framework of this study the analysis of the state of normative regulation of legal relations on the chosen subject of the following main periods was carried out: before the imposition of martial law on the territory of Ukraine and the period related to the armed aggression of the Russian Federation against Ukraine’s sovereignty. It is noted that in the period before the imposition of martial law in Ukraine, the national concept of protection and restoration of property rights of internally displaced persons and internally displaced persons has not been effectively applied. The provisions of the draft Law of Ukraine «On the Principles of State Policy in Transition» of August 9, 2021 are considered. It is proved that for effective legal regulation of problematic issues that may arise in the transition period, it is necessary to timely develop relevant legislation (regulations) that can solve the problems of legal protection of citizens of Ukraine and legal entities of Ukraine, rights and legitimate interests whose property rights have been violated as a result of the armed aggression of the Russian Federation and the temporary occupation of the territory of Ukraine. The existence of problems with the implementation of the Law of Ukraine «On Ensuring the Rights and Freedoms of Internally Displaced Persons» in the field of protection of property rights was identified; their importance and relevance were emphasized. It is established that the legislation of Ukraine in the field of legal regulation of property relations with the participation of internally displaced persons needs to be improved and appropriate changes made that will provide protection and additional guarantees for the exercise of property rights. In particular, they stressed the need to develop a mechanism to restore property rights, create a single database of property of internally displaced persons and adopt a special legal act governing guarantees of compensation for destruction (damage) of property due to hostilities, terrorist acts, sabotage caused by the military aggression of the Russian Federation. In addition, the need to stimulate the realization of entrepreneurial and innovative potential and further comprehensive scientific and legal research to create optimal conditions and increase the efficiency of entrepreneurial and innovative activities was emphasized.
The purpose of this study is to identify common approaches to obtaining rights to various intellectual property objects in the field of robotics through a qualitative and quantitative assessment of applications and received protection certificates. As a result of researching the activities of eleven well-known companies, we identified filed and active trademarks, patent applications, and copyright certificates. A qualitative analysis of the documents showed that, with a significant preference for patents, companies are not too interested in registering copyright, despite the fact that every four out of five inventions implement information and communication technologies and services and are carried out using software developments, which is copyright according to various national and international regulations. While patent protection has significant advantages, software algorithms can be more comprehensively protected with additional tools. The results of this study can be useful to various SMEs and startups for building strategies for obtaining intellectual property rights and practical activities.
The aim of the study is to assess the technological competitiveness of the leading countries and Ukraine as well as the formation of an innovation and investment mechanism to improve it. The article presents the scheme of research of technological competitiveness of the leading countries and Ukraine on the basis of qualitative and economic-statistical analysis, analysis of comparative advantages, grouping method and correlation-regression analysis. Analysis of foreign trade in high-tech products showed that the studied countries occupy more than half of this market. The studied countries take an active part in international economic relations since they have rather high export quotas but the ratio of the export of high-tech goods to GDP is very low. The analysis of comparative advantages showed that Ukraine has the greatest preference for the export of aerospace products, Germany for pharmaceuticals, China for office equipment, the United States for instrument making, and only China for telecommunications. It was determined that France, China, and South Korea have the highest level of innovation in national exports, and Ukraine and the Russian Federation have the lowest.
El artículo tiene como objetivo estudiar las opiniones de los expertos en el establecimiento de los tipos de propiedad intelectual y las relaciones jurídicas correspondientes que surgen en el espacio digital y requieren atención en el contexto educativo. Como resultado de una encuesta a 21 experimentados profesores de derecho, concluimos que la presentación de la propiedad intelectual en los marcos de competencia digital no puede estar limitada por los derechos de autor, aunque este aspecto es importante. Además de describir diferentes objetos de propiedad intelectual, el contenido de los marcos de competencia digital podría reflejar cuestiones tales como modernas mejoras legislativas, métodos para identificar a los titulares de derechos, formas de distribuir convenientemente obras y derechos, el valor de varios objetos de propiedad intelectual, formas de protección de software y cuestiones de protección de obras creadas por inteligencia artificial en los regímenes legales vigentes, métodos para detectar violaciones a los derechos de propiedad intelectual y mecanismos de compensación por la pérdida por violaciones a los derechos de propiedad intelectual que correspondan al nivel actual de desarrollo de las relaciones en el espacio digital.
The current directions of development of financial and economic potential on the example of united territorial communities of one region through the introduction of electronic technologies to select a promising area of development and create favorable conditions for modern business communications. The criteria for this selection are proposed and an expert evaluation is conducted to obtain the results of the study in Decision Making Helper©. The priority of small business in the financial and economic development of the region has been established on the example of four united territorial communities. The problems of small business development are identified and the introduction of the newest approaches to the organization of activity of united territorial communities in the system of infocommunication «community-business-power» with establishment of their priority is offered. Relevant recommendations for the application of algorithms for the development of small business to determine the priority area in various fields, which allowed to form the author's vision of solving problems based on the software used to acquire new competencies by potential users.
Research background: The article explicates the approach of assessing the factors of innovation cooperation of Ukraine and Scandinavian countries in the face of the new industrial revolution. Purpose of the article: The paper aims to assess the current state of cooperation between Ukraine and Scandinavian countries and define the most critical factors for its further development in the new industrial revolution. Methods: The article presents the research scheme of cooperation between Ukraine and Scandinavian countries based on qualitative and economic-statistical analysis, comparative advantages analysis, correlation-regression analysis. Findings & value added: As a result of the research, it was revealed that the main directions of innovation cooperation between Ukraine and Scandinavian countries are investment projects, technical assistance initiatives, experience and technologies transfer. The cooperation is mainly implemented in energy, information technologies, education, science and high-tech trade. Based on the eco-nomic-diplomatic component analysis, a forecast and the dynamics of trade turnover of Ukraine and Scandinavian countries are presented, including the critical for Ukrainian economy time-frame of 2013-2014. It has been revealed that economic diplomacy plays a vital role in establishing and expanding trade relations. To deepen the innovation cooperation between Ukraine and Scandinavian countries, the authors see the need for: (1) expanding spheres of cooperation through joint projects in infrastructure, energy, aerospace and pharmaceutical industries, and the production of components for automobiles; (2) conducting joint research on biotechnology and nanotechnology; (3) signing of agreements in order to establish partnerships between the universities of Scandinavian countries and Ukraine; (4) the introduction of state support for the aerospace industry, the creation of scientific and production clusters in this field; (5) further development and diversification of the Ukrainian IT services market and interaction with Scandinavian countries in this field.

The normative-legal and organizational-legal guarantees of entrepreneurial activity, enshrined in the Constitution of Ukraine, are studied. Particular attention is paid to constitutional restrictions in the field of entrepreneurial activity. Target of research is to study the constitutional guarantees of ensuring the right to entrepreneurial activity and to identify shortcomings in the mechanism of their implementation. The constitutional right to entrepreneurial activity and guarantees of its provision have been the subject of research by many scholars, in particular M.V. Vitruk, B.S. Ebzeev, M.I. Matuzov, M.P. Orzikh, M.I. Kozyubra, V.F. Pogorilka, P.M. Rabinovych, S.V. Riznyk, Yu. M. Todyky, O.O. Chub, V.M. Shapoval, V,S. Shcherbyna and others. Only some aspects of this issue were considered in the special literature, respectively, a comprehensive study of the constitutional guarantees of the right to entrepreneurial activity has not found its proper elaboration. Article’s main body. The guarantees of the right to entrepreneurial activity provided for in the Constitution of Ukraine are sometimes declarative in nature. This is due to the fact that regulations, specifying the Constitution of Ukraine, contain some inconsistencies and gaps.
