"破案"一词兼具"程序、步骤"和"过程"两方面的含义。作为"程序、步骤"的"破案",只是公安机关内部的一个行业用语,刑事诉讼法没有相关的规定,而且,其在侦查实践中的原有作用随着侦查体制的改革也已不复存在。"破案"的"程序、步骤"含义应当取消,"破案"不是刑事案件侦查的必经程序。

The criminal case detection curriculum is a trunk one of detection major in public security colleges.In the present teaching system there are problems that can't tally with the changes of detection idea,can't tally with the legal laws and regulations,and also problems which contents are repetitive and overlapping,the detection methods are imperfect Induced,and also the key points are not prominently emphasized.When reforming criminal case detection curriculum teaching system,we should take a case procedure as a master line to find commonness in each kind of criminal case detection methods,and merge the essential methods of the case investigation and detection evidence collections into one organic whole.Then aims at the characteristic of different case again,and to analyze difficulty and key of the detection.

强弱群体因贫富悬殊必然导致两者间存在巨大的政治、社会地位的"位差",而"位差"引发的"势能",其内聚力易使弱势群体形成组织化、政治化的集体,其外张力又易引发一起起群体性事件.要减弱弱势群体"位差势能"对社会稳定的冲击,一应缩小贫富差距,二应财富分配公平合理.在此基础上才有可能构建社会主义的和谐社会.

1加强现场勘查管理的必要性 侦查破案的目的,不仅是将犯罪人抓获,更重要的是将其移交起诉,使其受到应有的法律制裁.因此,对犯罪嫌疑人的刑拘转捕率、移送起诉率等,就是衡量刑侦部门侦查破案水平的一个标准.

目前投毒杀人案件证据调查需在三个方面改进,一是更新证据调查意识,修正认为投毒杀人案件都具有激化杀人的因果性、作案人以女性为主、查明了案件事实也就是证明了案件事实等三个认识误区;二是提高人证调查技能,纠正目前询问取证缺乏广度和深度、重口供的获取轻口供的固定、提取检材不够规范等问题,改进鉴定方法和手段;三是完善物证调查方法,改变目前物证调查方法缺乏全面性和科学性、针对性不强、取证带有盲目性,物证的保管固定不够科学合法等现状.

Criminal suspect investigation and control is the fundamental work in criminal investiga-tion.Its quality has a direct effect on the hitting power of criminal crime and social stability.At present ,criminal suspect investigation and control isn't made full use in criminal investigation, which results in much more put in manpower and material resources and low efficiency in solving cases.How to strengthen criminal suspect investigation and control should be discussed from the aspects of recognition,working mechanism and working method.It has practical significance to strengthen criminal investigation practice and improve efficiency.
