Стаття присвячена аналізу співвідношення права на освіту та доступу до освіти в міжнародному праві та національному законодавстві України. Розглянуто теоретичні основи права на освіту як універсального права людини згідно з Міжнародним пактом про економічні, соціальні та культурні права (ст. 13) та Загальним коментарем № 13 Комітету ООН з економічних, соціальних та культурних прав (рамка «4 A’s»: наявність, доступність, прийнятність, адаптованість). У національному законодавстві проаналізовано закріплення цього права в ст. 53 Конституції України та ст. 3 Закону України «Про освіту», де право на освіту включає право на доступність освіти, а держава забезпечує рівні умови доступу без дискримінації. Особливу увагу приділено поняттю доступу до освіти як ключової складової права на освіту, з розрізненням формального (де-юре) доступу – наявності юридичного права на участь в освітніх програмах – та реального (де-факто) доступу, що залежить від усунення бар’єрів. Підкреслено, що доступ є необхідною умовою реалізації права, але не вичерпує його повністю, оскільки право на освіту охоплює також якість, прийнятність та адаптованість. В умовах воєнного стану в Україні проаналізовано специфіку доступності освіти: руйнування інфраструктури, обмеження фізичного доступу через обстріли та безпекові заходи, нормативні зміни (наприклад, обмеження форм навчання в аспірантурі), проблеми цифрової доступності, міграція та нерівність для вразливих груп. Показано, що держава намагається забезпечувати освітній процес за державними стандартами, але стикається з низкою викликів. Порівняльний аналіз демонструє динамічний зв’язок: доступ виступає «мостом» між декларативним правом та його фактичною реалізацією, а порушення доступу є одним із основних видів порушення права на освіту. Перспективи вдосконалення пов’язані з гармонізацією законодавства з міжнародними стандартами, усуненням бар’єрів та забезпеченням ефективної доступності в умовах війни та післявоєнної реконструкції.
The article examines the theoretical and practical foundations of strategic adaptation for public and freight transport enterprises in a wartime economy. It is noted that the functioning of the transport sector is accompanied by an increased level of uncertainty, heightened security, logistical, economic and operational risks, as well as changes in the structure of demand for transport services. The necessity of implementing proactive management approaches, based on the integration of risk management into the overall strategic planning system, is substantiated. The main challenges are examined, including disruptions to logistics chains, the destruction of transport infrastructure, resource constraints, staffing imbalances and the increased role of state regulation. It is emphasised that risk management is a key component for ensuring the continuity of transport enterprises’ operations and the development of adaptive strategies in crisis situations. A generalised model of interrelationships is proposed, covering the stages of risk identification, assessment and mitigation, combined with the development and implementation of strategic approaches to adaptation. The main areas of adaptation have been systematised, such as: operational flexibility, resilience in the use of resources and energy, financial stability, workforce adaptation, digitalisation and the establishment of institutional partnerships.
Обгрунтування. Пухлинний процес всередині ока охоплює більшу частину внутрішнього периметра: від райдужної оболонки до диска зорового нерва. Водночас, інформації про неопластичні зміни ендотелію десцеметової оболонки мало, хоча клітини цієї тканини схильні до проліферації та патологічного розростання. Мета. Представити гістоморфологічну картину незвичайної проліферації ендотелію десцеметової оболонки, яка мала деякі ознаки новоутворення. Матеріали та методи. Гістоморфологічну картину унікального патологічного процесу вивчали на 40 серійних зрізах очного яблука. Гістологічну картину порівнювали з клінічною. Результати. Гістоморфологічне дослідження виявило облітерацію іридокорнеального кута з фіброзно-гіалінозом дренажної зони та неопластичні зміни всередині ока: кавернозна гемангіома, неопластичні комплекси сплющених кругло-овальних непігментованих клітин у зонулі Цинна, у передній камері, на передній поверхні райдужної оболонки та ідентичні клітинні комплекси вздовж поверхні десцеметової оболонки. Висновок. Вперше було зроблено акцент на можливості неопластичного процесу в ендотелії десцеметової мембрани, реалізація якого надзвичайно складна через відсутність стромально-судинного пулу в цій тканинній системі.
The article traces the main stages about political responsibility ideas formation: from its initial moral and social interpretation in the ancient Eastern tradition and antique political-philosophical thought to its gradual acquisition of public, institutional, and political-legal meaning in the Roman, medieval, modern, and contemporary periods. It is demonstrated that, at the early stages in the development of political thought, responsibility was predominantly associated with proper human conduct, the fulfillment of duties, adherence to moral order, and the maintenance of social harmony. At the same time, already in ancient Greece, as the polis emerged as an organized political community, responsibility began to be understood not only as an individual moral characteristic, but also as a condition for the common good preserving, the stability of political order, and the public authority proper functioning. It is shown that the Roman period played an important role in the further development of this issue, as responsibility increasingly became associated with the performance of public duties, the operation of law, and the functioning of institutionally organized state power. The significance of medieval political thought is also emphasized, as during this period responsibility began to be linked to the legitimacy of power, the limits of lawful rule, the common good, and the requirements of good governance. Particular attention is paid to the period of the formation of the modern state, when responsibility moved beyond a purely moral dimension and acquired a distinct political and legal meaning. It is established that the institutional changes of the seventeenth and eighteenth centuries, associated with the development of the social contract ideas, constitutionalism, popular representation, and the separation of powers, created the basis for a new understanding of political responsibility as an integral element of legitimate, limited, and accountable government. The article also emphasizes that, at the beginning of the twentieth century, political responsibility gradually transformed from a derivative element of moral or official duty into an independent political category directly connected with the functioning of political systems, the activity of parties, electoral mechanisms, bureaucracy, institutions of representation, and institutional control. The main trends in the understanding of political responsibility in the second half of the twentieth century and at the beginning of the twenty-first century are analyzed. It is shown that during this period its content significantly expanded: from the responsibility of the government and ministers before parliament to a multi-level system encompassing electoral accountability, institutional control, public evaluation of the actions of those in power, communicative accountability, transparency, media activity, judicial oversight, and other dimensions. It is substantiated that the contemporary understanding of political responsibility is also shaped by the regimes hybridization, democratic backsliding, the digitalization of politics, and the political representation crisis. It is concluded that the evolution of the political responsibility concept reflects the overall logic of the state historical transformation, its institutional structure, and the exercising power mechanisms. Political responsibility appears as a complex multidimensional category combining institutional, procedural, societal, communicative, and democratic-value dimensions, and serves as an important indicator of the political system level development and the degree of accountability of power to society.
