This article explores how law and the administration of justice shape the daily tasks of Buenos Aires Province Police officers and what legal knowledge they deploy to articulate their work with the judiciary. Based on 17 interviews conducted in 2021 with police personnel of various ranks in the city of Mar del Plata, the study analyzes how they interpret, apply, and negotiate legal norms, as well as the training challenges and tensions with procedural requirements. The methodological approach is qualitative and includes fieldwork combining semi-structured interviews and participant observation. The findings show that, far from being mere enforcers of the law, officers construct the meaning of legal norms in practice, mediating between their role as judicial auxiliaries, community demands, and their own institutional logics.
This paper analyzes the way in which the Buenos Aires political power addressed government problems related to public security during the first two decades since the return of democracy. We seek to determine the relevance that security had as the object of attention of the highest political authority of the district, in a long period that covers almost two decades, and to recognize the contents associated with the security issue, both in terms of diagnoses and measures, as well as more general political and ideological considerations. To achieve this, the messages of the governors on the occasion of the opening of legislative sessions between 1983 and 1999 are systematically analyzed. This clipping offers significant material to address the object of interest of our investigation. It is observed that issues such as crime and the police are the main elements considered in institutional discourses, and that both are worked on with different levels of detail, and with various approaches, at different times of the period that we analyze. The positions are placed within the framework of the more general political and social context, and in each of the successive government administrations that occupy the helm of the provincial State. This is intended to contribute to a general understanding of the place of security, and security policies, in contemporary Buenos Aires politics.
Foreign policy and defense constitute two essential functions of the modern state. There are various fields of intervention where both converge and the political leaders of these areas of public intervention are compelled to interact and combine actions to resolve conflicts or work out operational issues. In the case analyzed in this article, inter-ministerial coordination is put into action to deal with the request for seizure of the Frigate Libertad, training ship of the Argentine Navy, made by a vulture fund (holdout) in litigation with the Argentine Republic before the Ghanaian justice, as soon as the ship moors in the port of Tema in Ghana on October 1, 2012. To reconstruct the case, we rely on different documentary and journalistic sources, as well as interviews with key informants.

El objetivo de este artículo es determinar de qué manera los ciudadanos evalúan a la institución policial, y en particular el desempeño funcional y la actividad concreta de los agentes policiales, en el marco de sus experiencias cotidianas. Para ello nos apoyamos en los resultados de dos encuestas que realizamos en barrios populares de Mar del Plata durante 2021, y de medio centenar de entrevistas con pobladores de estos mismos barrios, que fueron interrogados sobre distintos aspectos de la situación de seguridad y la relación con la policía en su experiencia cotidiana. En consonancia con los resultados de investigación sobre América Latina, se observa que existen niveles relativamente altos de desaprobación del servicio policial. Esto va de la mano con un moderado sentimiento de desprotección. Paralelamente, existe una alta demanda de presencia policial, y de una actuación policial que se ajuste a las expectativas de la población. Pero como ni esta demanda ni estas expectativas son satisfechas, tienen a producirse juicios negativos sobre la institución y sus agentes. Esto no es incompatible con la idea de que la policía tiene limitaciones culturales, legales, presupuestarias y políticas para actuar como debería.
Se aborda el modo en que los agentes policiales realizan sus tareas de mantenimiento del orden y control del delito, identificando las continuidades y las rupturas que pueden observarse en la producción de seguridad durante la pandemia de COVID-19. El análisis se apoya en entrevistas con personal policial y con otros informantes clave, en particular, con participantes en los foros de seguridad, militantes sociales y dirigentes políticos locales. El trabajo de campo se realizó desde mediados de 2020 hasta finales de 2021, en el momento inmediatamente posterior a la aplicación de las medidas más drásticas de aislamiento social obligatorio. Según el estudio, la actividad policial vio inicialmente reducidas o suspendidas algunas de sus áreas habituales de intervención, como el control del delito callejero o la investigación criminal; en otros aspectos, siguió desempeñándose según patrones operantes antes de la pandemia, como la regulación de las violencias sociales en ciertos segmentos de la población. La novedad consistió en la generalización de los operativos de control de la circulación de las personas y la restricción a las reuniones sociales. En pocos meses, el policiamiento de la ciudad volvió a ordenarse según la configuración social e institucional previa a la pandemia.
A partir de entrevistas con magistrados de la justicia federal argentina, el artículo aborda desde una perspectiva sociológica ciertos aspectos del funcionamiento del poder judicial. En primer lugar, nos interesa interpretar la manera en que los jueces describen los procedimientos y redes que acompañan su acceso a la magistratura y la manera en que aparecen allí elementos que pueden ser considerados como relativos a la política. En segundo lugar, nos interesa reconstruir las maneras en que los jueces conciben su rol institucional y en qué medida el ejercicio de la función incluye aspectos que pueden ser definidos e identificados como políticos. En ambos casos, no se trata de preconcebir ciertas realidades aludidas como políticas, sino identificar la manera en que los jueces se refieren a lo político y el peso que le atribuyen en su actividad profesional. Proponemos un estudio de sociología comprensiva que recupera la perspectiva subjetiva de los actores y que se interesa por el modo en que construyen sentidos acerca de sus trayectorias, sus redes y sus actividades.De esta manera, pretendemos contribuir a una exploración de la politicidad del poder judicial que se aleje de los análisis institucionales, la crítica jurídica o cualquier otra perspectiva objetivista. En otros términos, nos interesa comprender los aspectos políticos de la administración de justicia desde las perspectivas de los propios agentes, relevadas a partir de entrevistas biográficas.
From their origins in the 19th century, the social sciences have treated law and justices as privileged objects, although naturally these were not the first critical and systemic approaches to these objects that used philosophy since the classical era and which have been addressed by political theory and legal science in modern day. Nevertheless, the social sciences’ approach to the world of law and the exercise of the judicial function differs greatly from that proposed by this normative disciplines. The social sciences perspective is essentially based on an operation that is quite simple: to consider law and justice as social facts (Durkheim, 2001 [1895]).
Dans cet article, qui s’appuie sur des faits observés dans le cas argentin, on analyse un phénomène largement étudié par la criminologie, la sécurité privée et la pluralisation de l’action de police, cette fois-ci du point de vue de la sociologie de l’action publique. On s’intéresse à la manière dont les logiques commerciales du marché de la sécurité privée sont mises en forme et intégrées dans les politiques publiques du secteur de la sécurité. La mise en politique de la sécurité privée suscite des controverses qui conduisent à enlever les obstacles normatifs empêchant sa reconnaissance officielle, et permettent ainsi son incorporation au système de sécurité publique. Elle entraîne aussi l’emboîtement de régulations publiques et privées qui façonnent le contenu et les contours de la sécurité privée. Elle contribue enfin à une pluralisation des régimes de prestation de sécurité.
When analyzing democracy, the social sciences look at recognition and acceptance of the institutions, actors, and actions that define politics. This relates to the representative dimension that, in different senses, democracy seeks to enshrine. To what extent does politics represent the interests and opinions of the social groups under its sway? What differentiated stances do citizens take toward different political objects? What factors play a role in determining preferences for and levels of satisfaction with the actors and institutions of democratic politics? Many studies have drawn attention to the lack of legitimacy of politics in contemporary democracies but, paradoxically, have also found that marked malaise with parties, politicians, and governments is accompanied by strong support for democracy as a form of government.
